DMCA Notice & Takedown Policy
Finmak Softwares respects intellectual property rights and expects users of Scan Partner to do the same.

This page explains how to submit a takedown notice under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) and analogous laws in India and other jurisdictions.
Important context: Scan Partner is an iOS app that stores documents on the user's own device. Finmak Softwares does not host, store, or distribute end-user scans on any server. As a result, most DMCA notices apply only to materials on this website (finmaksoftwares.in) and the Scan Partner App Store listing — not to user-scanned files on individual iPhones, which are outside our control.
1. Designated Agent
All DMCA notices must be sent to the designated agent below:

For complaints about content on the Apple App Store listing for Scan Partner, please also file a separate notice with Apple via their Content Dispute portal.
2. What to include in your takedown notice
To be effective, your notice must include all of the following (per 17 U.S.C. § 512(c)(3)):
- Identification of the copyrighted work you claim has been infringed (title, registration number if any, link to original).
- Identification of the infringing material and its location on our property (full URL on finmaksoftwares.in, or specific screen/asset in the Scan Partner app).
- Your contact information — full legal name, mailing address, telephone number, email.
- A good-faith statement: “I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
- An accuracy statement under penalty of perjury: “The information in this notification is accurate, and under penalty of perjury, I am the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
- A physical or electronic signature of the copyright owner or authorized agent.
Incomplete notices will be returned without action.
3. Our response
When we receive a valid notice we will:
- Acknowledge receipt within 3 business days.
- Investigate the claim.
- If the material is on our website or app marketing assets and the claim appears valid, remove or disable access to the material.
- Forward the notice to the alleged infringer (you waive any expectation of confidentiality regarding your name and contact information being shared with the alleged infringer in this context).
4. Counter-notice
If material you posted on finmaksoftwares.in was removed and you believe the takedown was a mistake or misidentification, you may submit a counter-notice that includes:
- Identification of the material removed and its previous location.
- A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
- Your full name, address, telephone number.
- Consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Finmak Softwares may be found).
- A statement that you will accept service of process from the original complainant.
- Your physical or electronic signature.
Send counter-notices to admin@finmaksoftwares.in with the subject line “DMCA Counter-Notice”.
5. Repeat infringer policy
Finmak Softwares may, in appropriate circumstances and at our discretion, terminate the accounts or licenses of users who are repeat infringers.
6. Misrepresentations
Under § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages. Please consider whether the material is actually infringing before submitting a notice.
7. Other jurisdictions
For Indian copyright complaints under the Copyright Act, 1957 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the same email and signature requirements apply. Indian notices must additionally state the complainant's authority to act and provide the relevant statutory references.
For complaints under the EU Digital Services Act or the UK Online Safety Act, please use the same channel and clearly identify the legal framework relied upon.
